A trust is an arrangement in which a settlor transfers property to a trustee to hold for beneficiaries under written terms. The settlor is the person who creates it.

Many people asking this question are thinking about a revocable living trust. A settlor can usually change or revoke this type of trust while alive, unless its terms say it is irrevocable, as § 736.0602 explains. An irrevocable trust is generally harder to change. How either type works depends on the terms the document actually contains.

Two things matter at the start. First, the document must meet legal requirements. Whether assets have been placed under the trust depends on the governing instrument and applicable Florida law. Missing either step can change the result. Whether you can do both tasks alone depends on the governing instrument, Florida law and the facts of each case.

Can You Legally Create a Trust in Florida Without an Attorney?

The statute sets out the requirements, and hiring a lawyer is not among them. Under § 736.0402, a trust is created only if the settlor has capacity, the settlor shows intent to create the trust, the trust has a definite beneficiary or fits a listed exception, the trustee has duties to perform, and the same person is not both sole trustee and sole beneficiary.

For a revocable trust, the capacity needed is the same as the capacity needed to make a will, under § 736.0601. A trust may also be created by a transfer to a trustee, by an owner declaring that they hold identifiable property as trustee, or by exercising a power of appointment, under § 736.0401.

Whether these requirements are met depends on the facts. A court or other person may ask later whether the settlor had capacity or intent. A trust procured by fraud, duress, mistake or undue influence can be void in whole or in part, according to § 736.0406.

Online Forms, Kits and Templates: What They Can and Cannot Check

Most online forms fill in blanks and produce a document. They generally do not review how your family, property and goals fit together.

A template may not address several common situations. It may not account for a child with a disability, property in another state, a business interest or a blended family. It may also not reflect the successor trustee and distribution terms you actually want.

Execution rules are a common trap. For a revocable trust created by a Florida domiciliary, the testamentary parts are invalid unless the trust is executed with will formalities, under § 736.0403. Whether that rule applies depends on where the settlor lived and when the trust was created. Review any form against your own facts before you rely on it.

Funding the Trust: Moving Your Assets Into It

Funding means putting property in the trust’s name or directing it to the trust. Which property a trust controls depends on the governing instrument and applicable Florida law. Whether assets held in your own name pass under a trust’s terms depends on the governing instrument and applicable Florida law.

Common funding steps include deeding real estate, changing account titles and reviewing beneficiary designations. Each step depends on the asset and the institution’s requirements.

A home is a frequent question. A deed may be used to move a house into a trust, but recording, mortgage, homestead and title issues depend on the facts and Florida law. Banks and title companies may ask for proof of the trust. A trustee may furnish a certification of trust instead of the full document. That certification may state the trust’s existence, the settlor, the acting trustee and the trustee’s powers.

An unfunded or partly funded trust may not operate the way you intend. Confirm how each asset will pass after funding.

Pour-Over Wills and Related Estate Planning Documents

A pour-over will directs assets not transferred to the trust during life into it after death. Whether it works this way depends on the will’s wording, the trust terms and Florida law. Assets that pass under a will may go through probate, and how that proceeds depends on the facts.

A will generally must be in writing, signed at the end, and witnessed by at least two attesting witnesses, under § 732.502. No particular set of words is required if those formalities are met.

Many people also ask about related documents. A durable power of attorney lets an agent act for you. Under § 709.2104, it stays in effect after incapacity only if it contains the statutory words or similar words showing that intent. A designation of health care surrogate and a HIPAA authorization address medical decisions and records. Their scope depends on the document and applicable law.

These documents work together. Inconsistent provisions across a trust, will, power of attorney and beneficiary forms can create questions later. How those questions are resolved depends on how each document is written.

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Where Self-Drafted Trusts Can Create Questions Later

Self-drafted trusts can raise questions later, but whether they do depends on the document and the facts. Common issues include vague distribution language, no successor trustee, incomplete funding and conflicts with a will or beneficiary designation.

Capacity and undue influence are another area. If a family member claims a settlor was pressured or lacked capacity, the outcome depends on the evidence and the facts of each case.

Depending on the governing trust instrument, applicable Florida law and the facts of each case, disagreements among beneficiaries or fiduciaries may lead to a trust dispute. Whether and how a dispute proceeds depends on the instrument, the law and the facts. Time limits also matter. Under § 736.0604, a contest of a trust that was revocable at death is barred if not started within the earlier of the chapter 95 period or six months after a required notice. How that applies depends on the case.

Whether a trust drafted without legal review is valid depends on the governing instrument, applicable Florida law and the facts of each case.

Situations Where Legal Review May Matter

Legal review may matter most when a situation has more moving parts than one home and a few accounts. Several circumstances are worth raising with a lawyer before you sign.

A child or relative with a disability may need a special needs trust. Eligibility for public benefits can depend on the trust’s terms and the facts, so a home-made trust for that purpose may create questions. Other circumstances include business ownership or succession, real property in more than one state, blended families and a trust created for someone who is seriously ill.

If you act for someone else, confirm your authority before you sign or transfer property. The authority you hold depends on the document and the facts.

Leslie V. Marenco may advise or represent clients on trust drafting, trust administration and trust disputes, subject to the governing trust instrument and applicable Florida law. That work depends on the governing instrument, applicable law and the facts of each case. For a wider view, see estate planning attorney services.

Changing or Revoking a Trust After It Is Signed

Whether a trust can be changed or revoked depends on its terms, its type and Florida law. A trust that is not expressly irrevocable can generally be revoked or amended by the settlor, under § 736.0602.

If the trust states a method, the settlor may use it by substantial compliance. If it states no method, a later will or codicil that expressly refers to the trust may work. Another method may work if it shows clear and convincing evidence of the settlor’s intent. Each route depends on the facts.

The settlor’s capacity at the time of a change is measured as the capacity to make a will, under § 736.0601.

A change may also require retitling assets or updating a pour-over will, beneficiary forms and powers of attorney. Keep the signed documents, funding records and amendments together. Their combined effect depends on how they fit.

Talking Through Your Trust Questions With Trust Counsel

If you’re reading this for a parent, a spouse or another relative, you may be facing a health change, a property decision or a family disagreement you did not plan for.
