Yes, in Florida a personal representative can resign. The resignation has to go through the probate court, though. It does not take effect just because the person has decided to quit. Under Fla. Stat. § 733.502, after notice to all interested persons, the court may accept a resignation and revoke the letters if the interests of the estate are not jeopardized by the resignation.

Questions about who carries out duties while a case is pending are worth discussing with an attorney. Acceptance also does not erase liability. The same statute says acceptance does not exonerate the personal representative or the surety from liability. A personal representative (often called an executor) who wants out needs a court-supervised process, not a private decision.

Three routes lead out of the role. The first is voluntary resignation, which is the focus here. The second is removal by the court. The third is ending the role through death or incapacity, which still leaves the estate needing someone new to act.

This page is the responsibility of Leslie V. That means the person must act for the estate and the interested persons, not for personal gain. Florida law says a personal representative must observe the standards of care that apply to trustees. The duty is to settle and distribute the estate in accordance with the decedent’s will and the Florida Probate Code, as expeditiously and efficiently as is consistent with the best interests of the estate (Fla. Stat. § 733.602).

The duties are concrete. Unless an inventory was filed earlier, the personal representative must file a verified inventory. It lists each estate asset with its estimated fair market value at the date of death (Fla. Stat. § 733.604). The representative must also file a verified inventory of estate property, listing it with reasonable detail and its estimated fair market value at the date of death.

Liability is real. A personal representative’s fiduciary duty is the same as a trustee’s. The representative is liable to interested persons for loss caused by a breach (Fla. Stat. § 733.609). Stepping down does not wipe out questions about past conduct.

Ways a personal representative can leave the role

Resignation is the personal representative’s choice, made through a court filing. Removal happens when the court or an interested person asks the court to end the appointment. Death or incapacity ends the representative’s ability to act, and the court must then deal with the estate’s next steps.

Incapacity is also a listed cause for removal (Fla. Stat. § 733.504). That means a representative who can no longer perform the job may face court action, even without a resignation.

Joint representatives follow different rules. Unless the will provides otherwise, a majority of joint personal representatives appointed under a will or codicil executed on or after October 1, 1987, or appointed to administer an intestate estate of a decedent dying on or after October 1, 1987, must concur on all acts connected with administration and distribution of the estate, except when a joint personal representative receives and receipts for property due the estate, when concurrence cannot readily be obtained for emergency action needed to preserve the estate, or when a joint personal representative has been delegated to act for the others (Fla. Stat. § 733.615). Before accepting a resignation, the court must determine whether a successor fiduciary is needed, and if no joint personal representative is serving, it must appoint a successor (Fla. Prob. R. 5.430).

How a resignation proceeds through the Florida probate court

A resignation starts with a written petition filed in the estate’s court. Under Fla. Prob. R. 5.430, the petition must state that the representative wants to resign and be relieved of all duties. It must also describe the estate’s status and state that the estate’s interests will not be jeopardized if the resignation is accepted. It must also state whether any proceeding for accounting, surcharge, indemnification or other proceeding against the representative is pending, and whether a successor fiduciary is needed.

The petition must be served by formal notice on all interested persons and on the surety, if there is one. Before accepting, the court decides whether a successor is needed. The court may then accept the resignation and revoke the letters, if the estate’s interests are not jeopardized.

When the court accepts, it must appoint a successor personal representative, or a curator to serve until one is appointed (Fla. Stat. § 733.503). The resigning representative then has 30 days after the letters are revoked to file an accounting and a verified petition for discharge (rule 5.430(g)).

What must happen to estate property and records during the handoff

The handoff is strict. Once the court accepts the resignation, estate assets, records and papers must be surrendered immediately to the remaining personal representative or the successor fiduciary. The court can set conditions on anything the outgoing representative keeps until the final accounting is approved (Fla. Stat. § 733.5035).

Keep estate money separate from your own. Do not move estate property into your name or use it for yourself. Holding or acquiring conflicting or adverse interests against the estate that will or may interfere with the administration of the estate as a whole is a listed cause for removal, except that it does not apply to a surviving spouse exercising the right to the elective share, family allowance, or exemptions (Fla. Stat. § 733.504).

If you learn that property was missing from the original inventory, you must file an amended or supplementary inventory (Fla. Stat. § 733.604). Missed accounting or delivery steps can lead to contempt proceedings under rule 5.430(j). Open duties still apply after you resign: you remain subject to contempt proceedings if you fail to file an accounting or deliver estate property and records within the time required. For the inventory duties in more detail, see probate inventory requirements in Florida.

Resigning compared with being removed

Resignation is started by the personal representative. Removal is started by the court or by an interested person filing a petition (Fla. Stat. § 733.506). The court must then revoke the letters of a removed representative.

Removal grounds are listed by statute. A removed representative must file an accounting within 30 days and deliver the records and property (rule 5.440(b) and (c)).

Removal does not end liability either. Whether a court accepts a resignation or orders removal depends on the facts of the estate. For a closer look at that path, see how a personal representative can be removed in Florida.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

If you have been appointed and are unsure how to proceed

Many people become personal representatives after a family member dies.
