A distribution is a payment or transfer of trust income or principal to a beneficiary. Refusals come in several forms:

A flat “no,” with or without a reason.

An unexplained delay that drags on for months.

A repeated “not yet” with no written explanation.

This page is written for named beneficiaries, heirs, and family members who act for a relative. The trust document usually decides whether a payment is required or left to the trustee’s judgment.

A mandatory distribution is one the trustee must make under the trust’s terms. A distribution subject to the trustee’s discretion is different, even when the trust states that discretion as a standard or pairs it with directive language (Fla. With two or more beneficiaries, the trustee must act impartially (Fla. The trustee must also act as a prudent person would (Fla. Stat. § 736.0804). As between a trustee and the beneficiaries, a trustee must administer the trust solely in the interests of the beneficiaries (Fla. Stat. § 736.0802).

Even when a payment is discretionary, a beneficiary can sue for an abuse of discretion or a failure to follow a distribution standard (Fla. Stat. § 736.0504).

Your Options When a Trustee Will Not Distribute

Beneficiaries usually start by asking for information, then move to a written demand, mediation, or a court petition. Each step builds on the one before it.

Request the trust and information. On reasonable request, a trustee must give a qualified beneficiary a complete copy of the trust instrument. The trustee must also share relevant information about assets, liabilities, and administration (Fla. Stat. § 736.0813).

Send a written demand. Name the trust, the distribution you expect, the date of your request, and the response date you need. Keep a copy of everything you send.

Try mediation. The American Arbitration Association describes mediation as a way to resolve disputes outside of court (AAA, mediation).

Petition to remove the trustee. The settlor, a cotrustee, or a beneficiary may ask the court to remove a trustee (Fla. Stat. § 736.0706). The grounds include a serious breach of trust, or persistent failure to administer the trust effectively where the court determines that removal of the trustee best serves the interests of the beneficiaries.

Seek a remedy for the breach. It may also reduce or deny the trustee’s compensation (Fla. The exact path depends on the facts.

Step 1: Review. Read the trust, its amendments, and the distribution history. Decide whether the payment is mandatory or discretionary.

Step 2: Demand. Send a written demand with a response deadline. Ask for an accounting in the same letter.

Step 3: Negotiation or mediation. The parties discuss a resolution they can put in writing, when the facts support it.

Judicial proceedings concerning trusts. Judicial proceedings concerning trusts are commenced by filing a complaint and are governed by the Florida Rules of Civil Procedure, subject to the exceptions in the statute (Fla. Stat. § 736.0201). The trustee then has a chance to respond.

Step 5: Discovery and hearings. Information is exchanged, and the court hears the issues. Timing varies with each case and the court’s calendar.

What to Gather Before You Contact an Attorney

Gather the trust document, every amendment, and a written record of each request you have made. A complete file makes the first review faster.

The complete trust document, including every amendment or restatement, and any pour-over will.

The settlor’s death certificate, plus the trustee’s name, address, and date of appointment.

Account statements, prior distribution notices, and any accountings you have received.

Written correspondence with the trustee, including unanswered requests and the dates you sent them.

A short timeline of each refusal or delay, with what the trustee said each time.

Write the timeline with plain dates and exact quotes where you can.

How Trust Counsel, PL Approaches These Matters

Trust Counsel, PL focuses on trust and estate disputes, and it frames each matter around the reader’s role.
