An estate administration case in Broward County moves through several required stages, and its length depends on the facts: the assets, the debts, and whether anyone disputes the will.

The personal representative (often called an executor) is the person the probate court appoints to settle the estate of the person who died, called the decedent. Florida law sets milestones along the way, not one finish date. The most important marker is the payment deadline. The personal representative shall pay all claims within 1 year from the date of first publication of notice to creditors, provided that the time shall be extended with respect to claims in litigation, unmatured claims, and contingent claims, and the court may extend the time for any claim upon a showing of good cause (statute).

Think of that deadline as a checkpoint, not a finish line. Other steps, including the final accounting and discharge, come after the payment markers pass.

What a professional executor does in a Florida probate administration

The personal representative gathers and protects the decedent’s property, pays valid debts, and distributes what remains.

That role is a fiduciary (someone who must put the estate’s interests ahead of their own). Florida requires the personal representative to observe the standards of care that apply to trustees.

Here is how the roles fit together. Trust Counsel’s attorneys can serve individually as trustee or personal representative. The firm advises and represents trustees, personal representatives and beneficiaries. The firm does not serve as personal representative itself.

Who may serve as personal representative in Florida?

Florida law sets out who may serve as a personal representative, and the code’s limits apply.

How is a personal representative paid?

The stages of estate administration in Broward County

In a professional executor estate administration Broward County matter, the stages run in a set order.

First, someone files a petition. Any interested person may petition for administration.

Second, the personal representative publishes notice to creditors. Fla. Stat. § 733.2121 The personal representative must also make a diligent search for reasonably ascertainable creditors, including unmatured, contingent or unliquidated claims, and serve them, except creditors who have filed a claim, whose claim has been paid in full, or whose claim is listed in a timely filed proof of claim. Impracticable and extended searches are not required.

Third, creditors must file claims. § 733.702 A late claim is barred unless the court extends the time, and only for fraud, estoppel, or insufficient notice of the claims period.

Fourth, objections and payment. A claim against the estate is binding only if filed in the probate proceeding by the later of 3 months after first publication of the notice to creditors or, for a creditor required to be served, 30 days after service, unless the court extends the time for fraud, estoppel, or insufficient notice. The section also does not affect a proceeding to enforce a mortgage, security interest, or other lien on the decedent’s property; a proceeding to establish liability protected by casualty insurance, to the limits of that insurance; or a cross-claim or counterclaim in an action the estate brings. Under Florida’s probate code, no personal representative can be compelled to pay the decedent’s debts until after the expiration of 5 months from the first publication of notice to creditors.

Finally, once administration is complete, the personal representative is discharged.

Factors that lengthen or shorten an administration

Four things drive the length most: the estate’s complexity, business interests, disputes, and late or disputed claims. Each one adds work or waiting.

Complexity grows with the number of accounts and properties. Assets held out of state or abroad add records to collect and verify. Each record needs a check before it can be counted.

Business interests add a different kind of work. Shares in a closely held company need a value and a plan for who runs the company next. That plan can take longer than collecting a bank statement.

Tax filings add their own deadlines. Where federal estate tax applies, the return is due within 9 months after the date of death. IRC § 6075(a) Florida’s claim and payment markers run on a separate clock, so both calendars need tracking.

Clear documents help. A clear will and heirs who agree tend to keep the steps moving.

When a dispute can extend the timeline

A dispute adds steps, and each step adds time. ACTEC explains that disagreements among beneficiaries, family members, or creditors can lead to court involvement in the administration process. ACTEC’s inheritance guide

Florida’s payment timeline stretches for some claims. The 1-year payment deadline is extended for claims in litigation, unmatured claims, and contingent claims, for the period necessary to dispose of those claims.

Disputes take several forms. Beneficiaries may challenge a will or a trust. A creditor may sue. Someone may question how the personal representative handled the estate. Each path follows its own court process.

The firm’s practice areas include probate litigation and trust litigation. Those matters take place in court, so the timeline follows the court’s schedule. No general page can predict how a particular dispute will end.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Documents and information that help an administration move forward

Gathering records early helps the personal representative and counsel move through each stage.
