The way you hold each asset and the timing of any transfer often decide what stays protected. This page answers a common question: How can I protect my assets from a civil lawsuit in Florida? It covers which assets Florida law protects, where that protection ends, and why timing matters. Leslie V. Marenco is the responsible lawyer for this page. Trust Counsel, PL has its only office in Coral Gables, Florida.

What a Florida civil judgment can reach

A creditor with a money judgment can usually reach property that Florida law does not exempt. Florida makes lands, goods and stock in corporations subject to levy and sale under execution.

Judgment liens on real property arise under Fla. Stat. § 55.10. Fla. Stat. § 55.10 A judgment, order, or decree becomes a lien on real property in any county when a certified copy of it is recorded in the official records or judgment lien record of the county, provided that the judgment contains the address of the person who has the lien or a separate affidavit stating that address is recorded simultaneously. For recordings made on or after July 1, 1994, that lien starts with an initial period of 10 years.

How much you can protect turns on three things. They are how each asset is titled, when you acquired it, and when the claim arose. The answer depends on the facts. Liability insurance is a separate layer. It may respond to a covered claim.

If a summons or demand letter has just arrived, you don't have to work out your next step alone, and we can talk through your options with you. Const. art. X, § 4. Fla. Const. art. X, § 4 That amount is small, so it rarely protects much on its own. The homestead is the largest protection. The next section covers it.

Retirement accounts, life insurance and annuities can also receive protection under Florida law. Those limits turn on the type of account, how it is owned, and who the beneficiary is.

Keep one point in mind. You can own several protected assets and still face a judgment against everything else you own.

Homestead: how the protection works and where it stops

Florida’s constitution protects your home from forced sale, but only up to set size limits. If the home is located outside a municipality, the constitution exempts it from forced sale to the extent of one hundred sixty acres of contiguous land and improvements thereon, as stated in Fla. Const. art. X, § 4. Inside a municipality, it reaches one-half acre. Fla. Const. art. X, § 4

It is tied to the home, not to every piece of real estate you own.

The constitution also lists exceptions. The homestead protection does not cover obligations for taxes and assessments. Fla. Const. art. X, § 4 reads: “except for the payment of taxes and assessments thereon, obligations contracted for the purchase, improvement or repair thereof, or obligations contracted for house, field or other labor performed on the realty, the following property owned by a natural person:(1) a homestead, if located outside a municipality, to the extent of one hundred sixty acres of contiguous land and improvements thereon, which shall not be reduced without the owner’s consent by reason of subsequent inclusion in a municipality; or if located within a municipality, to the extent of one-half acre of contiguous land, upon which the exemption shall be limited to the residence of the owner or the owner’s family.” It does not cover debts for buying, improving or repairing the property. It also does not cover obligations for labor done on the land. Those debts can reach the home even when it qualifies.

Whether a particular property qualifies turns on how and where it is held and used. Ask these questions early, before you rely on the protection.

Retirement accounts, life insurance and annuities

Retirement accounts, life insurance and annuities can receive protection under Florida law. The details control the result. Many people assume these assets are always safe, but that assumption can fail.

Three details matter most. A policy you own may be treated differently from one someone else owns.

Withdrawals and transfers made after a claim is threatened can be reviewed. Florida’s transfer rules reach transfers made with intent to hinder, delay or defraud a creditor. They apply whether the claim arose before or after the transfer.

Before you rely on any protection, confirm how each account is titled and who is named to receive it. Review the paperwork and the dates of recent changes. Small titling errors can matter.

Tenancy by the entirety for married couples

Married couples in Florida can hold a home as tenants by the entirety, a form of joint ownership. The state constitution recognizes this form of title between spouses. Fla. Const. art. X, § 4

Timing matters most.

Trusts: spendthrift protection and its limits in Florida

A valid spendthrift provision can keep a beneficiary’s creditors from reaching the beneficiary’s trust interest. It does not protect property you place in a trust for your own benefit. Florida’s rules draw this line clearly.

A spendthrift provision is valid only if it restrains both voluntary and involuntary transfers of the beneficiary’s interest. Fla. Stat. § 736.0502 Even then, it has exceptions.

The key questions are who created the trust and who benefits from it. This applies whether the claim arose before or after the transfer. This is the core risk when someone moves assets during a dispute.

Courts look at warning signs. It asks whether the transfer was disclosed or concealed. It also asks whether the debtor had been sued or threatened with suit, and whether substantially all assets were moved.

Keep clear records.

Business owners: entity structure and charging orders

An LLC can separate your personal assets from company debts. A member is not personally liable for a company debt just because they are a member or manager.

When a creditor of an LLC member wins a judgment, the usual remedy is a charging order. A charging order is a lien on the member’s transferable interest. It requires the company to pay the member’s distributions to the creditor. Fla. Stat. § 605.0503 For an LLC with more than one member, a court may not order foreclosure on the interest. A single-member LLC can face a court-ordered sale in some circumstances.

Those are your own promises and your own assets.

Courts may pierce a corporate veil where the facts show improper conduct. Misleading or defrauding creditors is one example of such conduct. Moving company ownership to family through a succession plan can also be reviewed under the transfer rules.

Nursing home and Medicaid questions

Long-term care planning is a separate question from lawsuit protection. It has its own rules and timing. The two questions can overlap when a judgment and care needs arrive at the same time.

The planning options turn on the person’s health, family situation and assets. Someone who can still make decisions may have different choices than someone who cannot.

Transfers made to qualify for care are a different legal question. A creditor may still challenge them under the transfer rules above. Review the timing of any move with the full set of facts first.

Families often ask about both issues at once. A good order is to understand what a creditor can reach today, then weigh planning options for the future.

What to do now if a lawsuit has been filed or threatened

If you have been served, read the summons first. The summons states the deadline to respond. Missing that deadline can allow a judgment against you without your side being heard.

Notify your liability insurers promptly. An insurer can only evaluate and defend a claim it knows about. Keep records of every transfer, account change and title change. Write down the date and reason for each one.

Avoid reactive moves. Discuss any planned move before you make it.

Lawsuits that involve a trust, an estate or a trustee follow different procedures. The trust litigation attorney page covers that context.

Talk with a Coral Gables trusts and estates attorney about your situation

If a summons or demand letter just arrived, or a family member has been sued, you are likely trying to understand your options quickly and under stress. Business owners often feel the same pressure when a claim reaches their company or their personal assets.

When you are ready to talk through your facts, call (305) 707-7126 or schedule a call online.
