Marenco · Published October 30, 2026

What evidence do you need to prove undue influence? Disputes over undue influence often turn on the facts surrounding how a document was prepared and who was involved in its preparation. Strong claims usually rest on records that show who had control, who arranged the document, and whether the result fits earlier wishes. This guide explains those categories in plain terms.

What undue influence means in a Florida will or trust contest

Undue influence is a term often used in disputes when someone questions whether a document reflects the maker’s own choices. The document ends up reflecting someone else’s wishes instead of the maker’s.

Undue influence comes up in a will contest or a trust contest. The same idea applies whether the challenged paper is a will or a revocable trust. Florida law says a will is void if its execution was procured by undue influence (§ 732.5165). A trust, or the part of a trust procured that way, is void too (§ 736.0406). Fla. Stat. § 736.0406 reads: “If the creation, amendment, or restatement of a trust is procured by fraud, duress, mistake, or undue influence.” If only part was procured that way, the rest can stand if it’s valid for other reasons.

Readers still learning how a trust differs from a will can start with our trust litigation attorney page. Florida law also has a rule that can shift that burden.

In a will contest, the proponent must first show that the will was formally executed and attested. After that, the contestant must establish the grounds for opposing probate (§ 733.107; see also Fla. Prob. R. 5.275). In a trust contest, the contestant has the burden of establishing the grounds for invalidity (§ 736.0207).

The presumption of undue influence is the burden-shifting rule. The statute says it implements public policy against abuse of fiduciary or confidential relationships. It shifts the burden of proof under sections 90.301 to 90.304 (§ 733.107). In plain terms, the presumption can move the burden onto the person defending the document.

Lawyers also separate putting enough evidence on the table from convincing the judge at the end. Keep both jobs in mind when you gather records.

The three elements courts examine

Practitioners often organize an undue influence claim around three questions. Was there a relationship of trust? Did the beneficiary take an active part in getting the document made? Does the result fit the maker’s own intent?

The Florida Courts probate memorandum on fraud and undue influence explains the definition. The statute, Fla. Stat. 733.107, provides that in any transaction or event to which the presumption of undue influence applies, the presumption implements public policy against abuse of fiduciary or confidential relationships and is therefore a presumption shifting the burden of proof under ss. 90.301-90.304.

First, the relationship. This is a confidential or fiduciary relationship, such as a caregiver, an agent under a power of attorney, or someone who manages the maker’s money. A relationship alone proves nothing. It raises the question of whether that trust was used to steer decisions.

Second, active procurement. The beneficiary took part in getting the document made. Examples include arranging the meeting, choosing or contacting the drafting attorney, or supplying the instructions.

Third, an unnatural result. The new plan shows a sudden change, a break from earlier plans, or a gift that makes little sense given family ties.

Each element needs its own evidence. The next sections cover those categories in turn.

Evidence of the relationship and the procurement

Records are the clearest proof of who controlled a person’s affairs and who arranged the new document. Start with the paper trail.

Financial records come first. Look for power of attorney forms, bank signature cards, online account access, and records of who paid bills or managed property.

Communications come next. Emails, text messages, calendar entries, and phone logs can show who contacted the drafting attorney and who scheduled the signing.

Drafting and signing records matter too. These include the drafting attorney’s file, who attended meetings, who gave instructions, and who was in the room at signing.

Witnesses add context. People who saw who controlled access to the maker, or who were present while the document was made, can describe it in their own words.

Prior versions of the plan give a baseline. Earlier wills and trusts show what the maker wanted before the change.

Florida’s probate code applies the civil rules of evidence in these proceedings unless the code says otherwise (§ 731.1035). That makes it important to preserve documents, emails and phone records early, before accounts close or devices are replaced.

Evidence of the person’s condition and the unnatural result

Medical records and the timing of changes help show how vulnerable the maker was and whether the result fits earlier wishes. Courts weigh the whole picture, not a single document.

Medical records from the period around signing can address memory, thinking, medications, and hospital stays. They show the maker’s condition on the dates that matter.

Isolation is another category. Evidence that family members or longtime advisors were kept away, or never told about the new plan, can matter. So can a short gap between a first meeting and the signing, or a rapid series of changes.

Compare the challenged plan with earlier plans and with what the maker said about their wishes. Note any explanation the maker gave for the change. Testimony from people who knew the maker well can add to this comparison.

If a signature is disputed, a forensic handwriting examination may come into play. The NIST handwriting examination program addresses the standards and limits of that analysis, so results should be read with those limits in mind.

The other side will review the same records. Organize your evidence to answer their likely explanations.

The two main types of influence and how evidence is organized

Undue influence usually takes one of two forms: open pressure or quiet control. A single case often includes both.

Open pressure includes threats, repeated demands, or constant insistence on a particular gift. Text messages, letters, and accounts from witnesses are common proof.

Control through isolation or dependence works differently. It may involve limiting visitors, managing daily life, or controlling money. Caregiving schedules, access records, and household accounts often show this kind of control.

Organize the proof by the three elements. Build a timeline that shows the relationship, who took part in the procurement, and how the result differs from earlier plans. A judge can then follow the chain of proof from start to finish.

Timing rules come from statute, and they matter. A will contest cannot be started before the death of the person who made the will (§ 732.518). A contest over a revocable trust cannot start until the trust becomes irrevocable by its terms or the settlor dies; if the whole trust has been revoked, a contest of the revocation cannot start until after the settlor dies (§ 736.0207). The same statute says it does not bar an action by the guardian of the property of an incapacitated settlor.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Next steps if you are reviewing a will or trust now

If you’re reviewing a will or trust now, start by gathering the documents and records you already have.
