Marenco · Published October 29, 2026

Probate is the court process that settles a deceased person’s estate. Litigation is a formal dispute, where one side files a claim and the other side responds. Probate moves forward on its own, while litigation starts when someone challenges a step.

Families often face both at once, which causes confusion. This page explains the difference between probate and litigation in Florida, where the two overlap, and which deadlines can limit your options.

What Is Probate?

Probate is the court-supervised process for settling a deceased person’s estate in Florida. A personal representative (often called an executor) handles the job. The work includes validating the will, listing the assets, paying valid debts, and distributing what remains.

The court oversees this process so creditors, heirs, and beneficiaries follow a defined path. The personal representative must promptly serve formal notice of the estate on the following persons who are known to the representative: the surviving spouse, beneficiaries, the trustee of certain trusts and each qualified beneficiary, and persons who may be entitled to exempt property. Those notices start clocks that matter later. Most probate steps move forward without a lawsuit. A fight usually begins only when someone objects to a step.

If you're handling a probate file you did not choose, we can help you sort out whether your matter is probate administration, probate litigation, or trust litigation. It usually includes written pleadings, a fact-gathering stage called discovery, motions asking a judge to rule on points, and sometimes a trial.

Trial is only one stage. Many disputes end earlier, through a settlement or a ruling on a motion. So the short answer to how litigation differs from trial is this: trial is one step inside litigation, not the whole process.

Litigation can happen in two ways in estate matters. It can occur inside an open probate case. It can also be a separate lawsuit, such as a trust dispute filed in its own action. Identifying the document and the court early helps you see which path applies.

Where Probate and Litigation Overlap: Probate Litigation

Probate litigation is a contested dispute that arises inside or out of a probate estate. It is not the routine paperwork of administration. It starts when someone challenges what the estate or the personal representative is doing, or has done.

Common examples include:

A will contest.

A removal request.

Will contests follow set rules. In Florida, an action to contest the validity of all or part of a will or the revocation of all or part of a will may not be commenced before the death of the testator. Fla. Stat. § 732.518

Probate litigation can be one contested issue inside an otherwise routine estate. It can also take over the whole case. The probate court already has the estate before it, which is why many estate disputes are raised there.

Probate Litigation vs. Trust Litigation

Trust litigation is a dispute over a trust, such as a trustee’s accounting or a beneficiary’s claim about the trust’s terms. A trust is generally administered outside probate. That is why a trust dispute can look like probate litigation but follows different rules.

A revocable trust can be changed by the person who created it during life. An irrevocable trust generally cannot be changed the same way.

The same family can face both. A will may go through probate while assets in a trust are contested separately. Sort out which document and which court each issue belongs to.

Trustee and personal representative are different roles, with different duties and court processes. Trust Counsel’s attorneys can serve individually as trustee or personal representative. The firm advises and represents trustees, personal representatives and beneficiaries.

Can an Estate Be Distributed Without Probate?

Yes, some property passes outside probate. How each asset is titled can affect whether it passes through probate, so reviewing how your property is held is a useful first step.

Florida also has a shortcut for some small estates. Under Fla. Stat. § 735.301, no administration is required if the estate leaves only certain exempt personal property. Nonexempt personal property must also stay within a set value. That value is the sum of preferred funeral expenses and reasonable medical and hospital expenses of the last 60 days of the last illness.

Whether a shortcut fits depends on the facts, including the estate’s value and the assets involved. Statutory wording can be technical, so review your specific situation with a lawyer before relying on it.

Why Deadlines Matter in Florida Estate Disputes

Florida sets short windows to object to a will. Missing one can end your objection. Under Fla. Stat. § 733.212, an interested person served with a notice of administration must object to the will’s validity, the venue, or the court’s jurisdiction within 3 months after service. Otherwise, those objections are forever barred.

The 3-month period may be extended only for estoppel based on a personal representative’s misstatement about the deadline. It may not be extended for other reasons, such as failure to disclose information. Under Fla. Stat. § 733.212, an interested person on whom a copy of the notice of administration is served must file any objection that challenges the validity of the will, the venue, or the jurisdiction of the court on or before the date that is 3 months after the date of service of a copy of the notice of administration on that person, and, unless sooner barred, no later than the earlier of the entry of an order of final discharge of the personal representative or 1 year after service of the notice of administration.

Venue follows the decedent’s home. Under Fla.
