Marenco · Published October 29, 2026

How much is an estate litigation lawyer? The honest answer depends on the facts of the dispute. Estate litigation is priced around the work a specific case requires, not a single published rate. This page explains how Florida estate litigation fees are usually structured, what pushes the total up, which costs sit outside the attorney’s fee, and what to ask before you commit to anything.

Short answer: why estate litigation fees vary

Estate litigation fees vary because every dispute asks for different work. Estate litigation means contested probate, will, and trust matters heard in Florida courts. A will contest, a claim against an estate, and a fight over a trustee’s conduct each need their own plan, filings, and hearings.

Heirs, beneficiaries, and fiduciaries can all end up in these disputes, and each role carries different work. A short disagreement between two siblings is not the same as a long case involving business interests in several states. For an overview of this work, see our probate litigation attorney services page. They charge by the hour, charge a flat fee for a defined task, or use another arrangement the lawyer and client agree on. Florida’s Rule 4-1.5 says a lawyer should, where appropriate, discuss alternative billing methods with the client. The same rule says general overhead belongs in the fee, whatever the billing method.

Who pays the fee also matters. Under Florida’s American Rule, each side generally pays its own attorney’s fees unless a contract or statute says otherwise, as the Florida Supreme Court in Price v. Tyler explains.

When a lawyer is paid from an estate, the court adds a layer of review. Attorneys for personal representatives are generally entitled to reasonable pay from estate assets without a court order. Still, upon petition of any interested person, the court may increase or decrease the compensation for ordinary services of the attorney, or award compensation for extraordinary services, if the facts and circumstances of the particular administration warrant. See Fla. Stat. § 733.6171. Ask the lawyer to explain the basis for the fee before work starts, and get the terms in writing.

Factors that move the total cost

The biggest cost drivers are complexity, how hard the other side fights, and how far the case goes. Several things push the total up or down:

Estate complexity: the number of assets, property in other states, business interests, and trust structures.

Contested or settled: a dispute that resolves early costs less than one that goes to trial.

Number of parties: every added heir, beneficiary, or creditor adds notices, filings, and conversations.

Steps taken: discovery, depositions, motions, mediation, and appeals each take time.

Amount at stake: the value at stake shapes how much work makes sense.

Florida law treats some estate work as extraordinary. Section 733.6171(4) gives examples of extraordinary services, which include involvement in a will contest, will construction, a proceeding to determine beneficiaries, a contested claim, an elective share proceeding, and any adversarial litigation by or against the estate, and the list is not limited to these. See Fla. Stat. § 733.6171. See Fla. Stat. § 733.6171. That list shows that extraordinary services, which include contested matters and also non-contested work such as tax advice, entitle the attorney for the personal representative to further reasonable compensation in addition to fees for ordinary services.

Costs beyond the attorney’s fee

Costs beyond the attorney’s fee include court charges, transcripts, and outside witnesses. Florida’s Rule 4-1.5 says filing fees, transcription, and similar charges should be passed to the client at the amount the lawyer actually pays. Common pass-through costs include:

Filing fees and certified copies

Deposition transcripts

Mediator fees

Records and subpoena costs

Appraisers, accountants, and other outside witnesses who give opinions

Some of these costs can reach a court’s review of compensation. If a court must decide whether a fiduciary’s pay is reasonable and testimony is offered, the court can award a reasonable witness fee and pay it from estate assets. See Fla. Stat. § 733.6175. Ask for a written list of which costs are included in the fee and which are passed through to you.

Fiduciary compensation is a separate question

A personal representative (often called an executor) or a trustee is paid separately from the lawyers who advise them. Florida law entitles a personal representative to a commission for ordinary services, payable from estate assets without a court order. See Fla. Stat. § 733.617. If a trust does not set a trustee’s pay, the trustee is entitled to compensation that is reasonable under the circumstances. See Fla. Stat. § 736.0708.

Keep three payments apart: the attorney’s fee for legal work, the fiduciary’s compensation for running the estate or trust, and outside costs. People often mix them up. They come from different sources and follow different rules.

Trust Counsel’s attorneys can serve individually as trustee or personal representative. The firm advises and represents trustees, personal representatives and beneficiaries.

Questions to ask at a first consultation

A first meeting is the right time to ask about cost. Bring these questions with you:

How is the fee billed, and what does the engagement agreement cover?

Which costs sit outside the fee, and how are they paid?

What does the first phase of work involve, and how is the budget discussed as facts develop?

Will fees paid from estate assets be subject to court review?

Who is responsible for the matter?
