Stat. § 736.0601 says the capacity needed to create, amend, revoke, or add property to a revocable trust is the same as the capacity needed to make a will. The same statute covers the power to direct the actions of a revocable trust’s trustee.

For wills, Fla. Stat. § 732.501 requires that the person be of sound mind and either 18 or older or an emancipated minor. Sound mind is the core question in a capacity dispute.

Understanding the Nature and Effect of the Change

Reviewing what an amendment does before signing is a practical step. That might mean adding a beneficiary, removing one, or changing a trustee. Knowing that a document was signed is not enough. It can also help to consider how a change may affect the trust property and the people named in it.

Someone can seem alert in conversation and still miss the effect of a specific change. Disputes often focus on that gap. A key question is whether the settlor could describe the family, the main assets, and what the new terms do, in their own words.

Florida also sets how a revocable trust is amended. Under Fla. Stat. § 736.0602, the settlor may amend by substantially complying with the trust’s own method. If the trust names no method, a later will or codicil that expressly refers to the trust or specifically devises property that would otherwise have passed according to the terms of the trust can do it, and so can any other method manifesting clear and convincing evidence of the settlor’s intent.

How Illness and Medication Enter a Capacity Challenge

A serious illness does not automatically mean a person lacked capacity. A diagnosis alone does not decide the question. The real question is whether the condition affected the settlor’s understanding on the signing day.

Conditions that often come up in these disputes include dementia, delirium, stroke, and severe infection. Medications with sedating or confusing effects, taken near the signing date, are also raised. Conditions can rise and fall, so a person may have clear periods and confused periods.

That is why the settlor’s condition on the signing date usually gets the closest look. A person who seemed fine at a family gathering weeks earlier may still have had a different picture on the day the document was signed.

Evidence Typically Relevant to a Capacity Question

Medical records from the weeks before and after signing are a common starting point. Hospital, physician, and pharmacy records show diagnoses, test results, and medications. Physicians who treated the settlor can explain their cognitive status and medication history.

The drafting attorney’s file also matters. Intake notes, drafts, and messages about the change can show who asked for it and what was explained. Attesting witnesses can describe the settlor’s questions, answers, and demeanor when the document was signed.

Family members, caregivers, and friends can describe day-to-day functioning near the signing date. Each source tells a different part of the story. Records made close in time to the signing are often the most useful.

Capacity Compared With Undue Influence and Execution Defects

Capacity asks whether the settlor could understand the change. Undue influence asks whether someone overcame the settlor’s free will. These are different questions, though the evidence can overlap.

The presumption of undue influence in certain fiduciary or confidential relationships appears in Fla. Stat. § 733.107. That statute (Fla. Stat. § 733.107) governs will contests, and its provision on the presumption of undue influence applies to any transaction or event to which that presumption applies, shifting the burden of proof under ss. 90.301-90.304.

Execution defects are a separate question. Florida’s will rules on signing and witnesses appear in Fla. Stat. § 732.502. Each ground needs its own review before anyone decides how to proceed.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Who Can Raise the Question and Why Timing Matters

While the settlor is alive, a revocable trust generally cannot be contested in the usual way. Under Fla. Stat. § 736.0207, a contest may not start until the trust becomes irrevocable by its terms or by the settlor’s death. The guardian of the property of an incapacitated settlor is not barred from bringing such an action.

Once a challenge is possible, deadlines apply. Under Fla. Stat. § 736.0604, an action to contest a trust that was revocable at the settlor’s death is barred if not started within the earlier of the time under chapter 95 or six months after the trustee sends a copy of the trust and a notice of its existence, the trustee’s name and address, and the time allowed for commencing a proceeding. The person contesting the trust carries the burden of proving the grounds, as Fla. Stat. § 736.0207 provides.

Waiting can also make proof harder. Medical files and witness contact details become harder to obtain over time.

Frequently Asked Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Q: Can someone with a serious diagnosis still sign a valid trust amendment?

A: A diagnosis alone does not decide capacity.
