Marenco · Published October 27, 2026

If someone outside the family pressured a relative into changing an estate plan, you may be able to sue that outsider. A lawsuit against a third party that interfered with an inheritance in Florida is a civil claim. It is separate from a challenge to the will or trust itself. This page explains how the claim works, what evidence matters, and when deadlines start to run.

What Is a Lawsuit Against an Outsider Over an Expected Inheritance?

A lawsuit against an outsider is a civil case against a person outside the family whose improper conduct cost you a gift you reasonably expected. Common plaintiffs include named beneficiaries, heirs who would take under the state’s default rules (intestate succession), and relatives whose expected share was diverted.

This claim targets the outsider’s conduct. A will or trust contest targets the document. Florida law says a will is void if its execution was procured by fraud, duress, mistake, or undue influence (Fla. Stat. § 732.5165). A trust created, amended, or restated the same way is void, or the part procured that way is void, while the remainder is valid if it is not invalid for other reasons (Fla. Stat. § 736.0406).

A claim against a personal representative or trustee for mismanagement is different again. It asks the court to hold a fiduciary accountable for how they handled the estate. Whether your situation fits one claim or several turns on the facts.

You did not choose this situation, and you may have a claim worth reviewing. Stat. § 736.08165 reads: “(1) Pending the outcome of a proceeding filed to determine the validity of all or part of a trust or the beneficiaries of all or part of a trust, the trustee shall proceed with the administration of the trust as if no proceeding had been commenced, except no action may be taken and no distribution may be made to a beneficiary in contravention of the rights of those persons who may be affected by the outcome of the proceeding. (2) Upon motion of a party and after notice to interested persons, a court, on good cause shown, may make an exception to the prohibition under subsection (1) and authorize the trustee to act or to distribute trust assets to a beneficiary subject to any conditions the court, in the court’s discretion, may impose, including the posting of bond by the beneficiary. Stat. § 736.08165) A party can ask the court for an exception for good cause. The court may attach conditions, including a bond posted by the beneficiary.

How Do Undue Influence, Tortious Interference, and Fraud Differ?

Undue influence attacks the document. Interference and fraud usually focus on the outsider’s own actions. Undue influence means pressure or manipulation that overcame the decedent’s free choice.

Where Florida’s presumption of undue influence applies, it implements policy against abuse of fiduciary or confidential relationships. It shifts the burden of proof (Fla. Stat. § 733.107). In a trust contest, the contestant must establish the grounds for invalidity (Fla. Stat. § 736.0207).

Forgery is a separate issue. It usually requires handwriting or document analysis. Each claim is hard to prove, and how hard depends on the evidence, the timing, and the relationships involved.

What Evidence Should You Gather Now, and Why Does Timing Matter?

Start preserving records as soon as you suspect a problem. Keep prior wills and trusts, beneficiary forms, emails, texts, bank statements, and care records you can lawfully obtain.

Patterns that often matter include:

A sudden change shortly before the decedent lost capacity.

Isolation from family.

A new person controlling money or access.

A change that benefits the outsider most.

Witnesses may include the drafting attorney, bank staff, doctors, and caregivers.

Deadlines are the hard part. A will contest cannot start before the testator dies (Fla. Stat. § 732.518). A revocable trust contest waits until the trust becomes irrevocable or the settlor dies (Fla. Stat. § 736.0207). Section 736.0207 does not prohibit an action by the guardian of the property of an incapacitated settlor (Fla. Stat. § 736.0207).

A person served with a notice of administration must object to the validity of the will, the venue, or the jurisdiction of the court on or before the date that is 3 months after the date of service, or those objections are forever barred. The 3-month period may be extended only for estoppel based upon a misstatement by the personal representative regarding that time period. Unless sooner barred, all such objections must be filed no later than the earlier of the entry of an order of final discharge of the personal representative or 1 year after service of the notice of administration (Fla. Stat. § 733.212). A contest to the validity of a trust that was revocable at the settlor’s death is also barred if not started within the earlier of the chapter 95 time limit or six months after the trustee sent the person a copy of the trust instrument and a notice (Fla. Stat. § 736.0604). Separate claims against an outsider may have their own timing rules, so starting early matters.

How Does the Case Usually Move Forward?

A case usually moves from a private review to filing, discovery, and then motions, settlement talks, or trial. Timing varies with the court’s calendar and the dispute’s complexity.

Intake and review. You share the documents, the timeline, and who benefited from each change.

Preservation and records requests. Letters ask the other side to keep and produce records. If a fiduciary is involved, an accounting request may be part of this step.

Actions shall be brought only in the county where the defendant resides, where the cause of action accrued, or where the property in litigation is located; this rule does not apply to actions against nonresidents (Fla.
