Marenco · Published October 27, 2026

If you’re trying to understand estate planning vs probate litigation in Miami-Dade, the difference comes down to timing and purpose. Planning builds the documents before a death. Litigation resolves the fight that can follow. This page explains each side, where they meet, and who can serve as a fiduciary under Florida law. It’s written for adult children, heirs, and beneficiaries who may be researching for a parent or sibling.

How do estate planning attorneys differ from trust and estate litigation firms that handle probate and trust disputes in Miami-Dade County?

Estate planning attorneys prepare documents before a death or incapacity. Trust and estate litigation attorneys resolve disagreements about those documents or about how a fiduciary is handling them.

Timing is the first difference. Planning happens while the client is alive and able to make decisions. Litigation usually starts after a death, during trust administration, or when a family disagrees.

The goals differ too. Planning aims to set clear instructions and reduce future conflict. Litigation aims to resolve a contested claim, either in court or through a negotiated settlement.

The clients differ as well. A planning client is the person making the decisions. A litigation client is often a beneficiary, heir, or fiduciary reacting to something already in motion. Trust Counsel, PL works on both sides from its Coral Gables office.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What does estate planning cover before a death or incapacity?

Estate planning covers the documents and decisions that guide a family before a death or incapacity. Common tools include wills, revocable trusts, durable powers of attorney, and health care documents.

Estate tax planning looks at how a larger estate is structured. Business succession planning sets out how ownership and management will pass to the next generation. Asset protection and guardianship nominations are also planning steps, not promises of any outcome.

Drafting quality matters. Unclear wording, outdated beneficiary designations, and trusts never funded with assets are common sources of later disputes. A litigation lawyer may later be asked to untangle them. Families with property in more than one place, or with relatives abroad, often face extra planning questions.

What do probate litigation and trust litigation cover after a death or during administration?

Probate litigation and trust litigation cover disputes that arise after a death or while a trust is being administered. These cases usually involve a will, a trust, or the conduct of the person in charge.

Challenges to documents are a common example. A will contest cannot start before the person dies (§ 732.518). An interested person served with a notice of administration generally has 3 months to object to a will’s validity (§ 733.212). A contest to a trust that was revocable at the settlor’s death is barred if not started by the earlier of the time set in chapter 95 or six months after the trustee sent the person a copy of the trust and a notice of the trust’s existence, the trustee’s name and address, and the time allowed to sue (§ 736.0604).

Other disputes involve a fiduciary’s conduct. These include accountings, distributions, and whether the fiduciary followed the document and Florida law. Beneficiaries and heirs also disagree about assets the documents never clearly addressed.

Florida’s probate code uses the term personal representative for the office that administers a decedent’s estate (§ 731.201). Some people call this role an executor. The same rules apply to the role, whatever the name.

Where do estate planning and probate litigation overlap in Miami-Dade County matters?

Estate planning vs probate litigation in Miami-Dade often becomes one story. The two practices meet when a planning document is challenged or does not work as intended.

An unfunded or poorly drafted trust can lead to an administration dispute years after the planning was done. A dispute over an amendment often starts with the signer’s capacity. Florida applies the same capacity standard to amending a revocable trust as to making a will (§ 736.0601).

Pressure on the signer can also matter. Under this section, the presumption of undue influence shifts the burden of proof in any transaction or event to which the presumption applies (§ 733.107). A will procured by fraud, duress, mistake, or undue influence can be void (§ 732.5165).

Business succession gaps create similar problems. Without written buy-sell terms, owners and family members may end up in a shareholder or family dispute. Some matters may be referred to another lawyer or firm, and this page says so plainly.

Who can serve as trustee or personal representative, and how does a law firm fit in?

The firm advises and represents trustees, personal representatives and beneficiaries. Florida trust companies, and state and national banking and savings associations authorized and qualified to exercise fiduciary powers in Florida, are entitled to act as personal representatives (§ 733.305).

Trust Counsel’s attorneys can serve individually as trustee or personal representative, and the firm advises and represents trustees, personal representatives and beneficiaries. That difference matters in practice. A fiduciary who is an individual may want advice from a lawyer. A beneficiary who disagrees with a fiduciary may need separate representation.

A personal representative’s commission for ordinary services is based on the compensable value of the estate, which is the inventory value of the probate estate assets plus the income the estate earns during administration (§ 733.617).

What should a Miami-Dade reader do if they are dealing with a will, trust, or fiduciary problem now?

Start by gathering the documents and writing down your questions. You may be holding a parent’s will after a death. You may be questioning a sibling’s handling of a trust. You may not know whether the problem is a drafting gap or a dispute.

Bring copies of the will and trust, any amendments, a list of assets, the names of the people involved, and any notice you received. Those papers help a lawyer see the timing questions early.

Leslie V. Marenco is the responsible lawyer for this page. Trust Counsel, PL’s only office is in Coral Gables.
