It is hard when the grounds are thin, the deadlines have passed, or the proof is weak. It is more workable when the timing is clear and the records support the claim. Two rules shape nearly every case. The person challenging the trust carries the burden of proof, and strict time limits apply.

Can You Challenge a Trust in Florida?

Yes. A trust can be challenged in Florida, but only on legal grounds and within the limits the statutes set. The person challenging the trust must prove those grounds. Fla. These are people whose share of the trust property could be affected by the terms or the changes.

If you’re reading this after a parent died or lost the ability to manage their affairs, you may be worried about a document you’ve never seen. Florida law says a trust, or the part of it, procured by fraud, duress, mistake or undue influence is void. Fla. Stat. § 736.0406 states that rule.

Each ground needs different proof. Capacity questions often turn on medical records and the settlor’s condition on the signing date. Undue influence questions often turn on who arranged the meeting and who was present. Forgery questions turn on handwriting and signing evidence.

A claim backed by documents is usually easier to evaluate than one based only on family impressions. That is why the proof matters so much. When you ask how hard is it to contest a trust in Florida, the answer starts with the ground you raise and the evidence behind it.

Lack of Capacity and Late Changes to a Trust

A settlor needs the same mental capacity to amend a revocable trust as to make a will. Fla. Stat. § 736.0601 sets that standard.

Changes made close to the end of life draw extra attention. People challenging late changes usually look at the settlor’s health records, the timing of the change, and who helped prepare the document.

Florida also sets out how a settlor may change a revocable trust. The settlor may follow a method the trust describes. If the trust names none, a later will or codicil that expressly refers to the trust, or that specifically leaves property that would otherwise have passed under the trust, can work, or the settlor can use any other method showing clear and convincing evidence of intent. Fla. Stat. § 736.0602 covers those methods.

If your concern is a document you believe the settlor never signed, read about forged trust amendments in Florida.

Trustee Conduct, Ambiguous Terms and Deadlocked Co-Trustees

Some trust disputes don’t ask whether the trust is valid. They ask whether a trustee acted properly. A trustee must administer the trust solely in the interests of the beneficiaries. Under Fla. Stat. § 736.0802, a trustee must act solely in the interests of the beneficiaries, subject to the exceptions the statute lists. Fla. Stat. § 736.0802 sets out this duty of loyalty.

When a trust term is unclear, the settlor’s intent controls. Fla. Stat. § 736.1101 says the settlor’s intent, as expressed in the terms, controls the legal effect of the gifts. Under Fla. Stat. § 736.1101(1), the intent of the settlor as expressed in the terms of the trust controls the legal effect of the dispositions made in the trust.

When co-trustees cannot agree, a majority can decide. Fla. Stat. § 736.0703 allows cotrustees who cannot reach a unanimous decision to act by majority decision.

Trustees also must keep beneficiaries informed. For an irrevocable trust, the trustee generally must provide an accounting at least once a year to each qualified beneficiary, subject to statutory exceptions. Fla. Stat. § 736.0813 covers those duties. For a trustee who sold trust property, see trustee sold trust property in Florida.

Why Timing and Evidence Drive the Difficulty

Florida sets firm deadlines for trust contests, and some of them start when the trustee sends notice. A contest to a trust that was revocable at the settlor’s death is barred if it isn’t started within the earlier of the chapter 95 period or six months after the trustee sends a copy of the trust and a required notice. Fla. Stat. § 736.0604 sets out that rule.

The notice must state that the trust exists, name the trustee and the trustee’s address, and give the time allowed to start a case. Separate rules apply to matters disclosed in a trust disclosure document. Under Fla. Stat. § 736.0604, a contest to a trust that was revocable at the settlor’s death is barred if not commenced within the earlier of the time provided in chapter 95 or six months after the trustee sent the person a copy of the trust instrument and a notice. Fla. Stat. § 736.1008 sets the time limits for a beneficiary’s claims against a trustee for breach of trust, including matters disclosed in a trust disclosure document.

Keep every letter, notice and accounting you receive. Their dates can decide which clock applies. Gather the full trust, every amendment, and any drafting file you can get. A missing amendment can change the whole picture.

Review your timeline promptly. Delay can affect which claims remain available to you.

Will Versus Trust, and Revocable Versus Irrevocable

A will usually goes through probate court, while a trust is generally administered outside it. That difference changes where and how a challenge is filed.

A revocable trust can be changed by the settlor during life. An irrevocable trust is generally harder to change. The LTCFE trust types guide notes that revocable and irrevocable trusts differ in how they are created and managed.

Will contests and trust contests follow different rules. In a will contest, the proponent first shows formal execution, and then the contestant must prove the grounds. Fla. Stat. § 733.107 sets that order. For a will, under Fla. Stat. § 733.107, after the proponent establishes formal execution and attestation, the contestant has the burden of establishing the grounds on which probate is opposed or revocation is sought.

If you’re asking whether you can start a challenge on your own, read can I contest a trust myself in Florida.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why No One Can Predict the Result of a Trust Contest

How hard is it to contest a trust in Florida? No one can predict that from the outside. Each contest turns on its own facts, documents and evidence. No lawyer can promise an outcome, and a statement that promises one should raise questions.

A careful review usually covers the trust and each amendment, the timeline of signings and changes, the records about the settlor’s health, and any notices the reader received. That review shows which grounds the documents might support and which deadlines may apply.

Common Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can a revocable trust be contested after the settlor dies in Florida?

Yes, but the contest can’t start until the trust becomes irrevocable by its terms or by the settlor’s death, and a guardian of the property of an incapacitated settlor may bring such an action. Fla.
