Marenco · Published October 26, 2026

The main downsides of putting land in a trust are extra deed work, possible lender and title insurance problems, less direct control, the risk of family disputes, and questions about homestead and taxes. How much each one matters depends on the type of trust and how the deed is written. Here is what to weigh before you decide.

Land Trusts and Living Trusts: Why the Difference Matters

Putting land in a trust usually means one of two tools, and their downsides are not the same. A revocable living trust is a trust the owner can change while alive. A land trust is mainly used to hold title to real estate, with the trust terms setting how the property is managed.

Florida law lets a trust be created in several ways. A trust can start with a transfer of property to a trustee during the owner’s lifetime, by will or other disposition taking effect on the owner’s death, by the owner declaring that they hold identifiable property as trustee, or by exercise of a power of appointment in favor of a trustee. Fla. Stat. § 736.0401 sets out those methods. Fla. Stat. § 736.0401 sets out those methods.

Because the two tools work differently, the downsides below depend on which type is used. If you’re reading this for a parent or relative, the same questions still apply. You may be trying to understand a plan someone else chose, and why.

If you're weighing a parent's plan or reviewing a deed you already signed, we can talk through your property and what each downside means for it. Each benefit comes with a cost, and the cost is the real question. Probate is the court-supervised process for settling an estate. ACTEC’s explainer on probate describes how that court supervision works.

The idea behind a trust is that property already titled in the trust is handled under the trust’s terms instead of through that court process. Many owners also value keeping the trust’s terms out of public view. If the owner becomes unable to manage property, a trustee can step in under the trust’s terms.

Read each benefit next to its cost. The sections below cover deed work, lender issues, less direct control, disputes, and homestead and tax questions.

Funding Work and Deed Transfer Costs

A trust does not hold land the owner still holds in their own name. To put land in a trust, the owner signs a new deed that moves title to the trustee. Reviewing how title to each asset is recorded can help show whether it is actually held in the trust.

This step has real costs. Recording fees, title or transfer charges, and document preparation may all apply. Ask for the full list before you start, because the amounts depend on the property and the county.

A deed that is recorded wrong, leaves out part of the land, or misnames the trustee can leave the intended result unclear. Family members may then argue about what the owner meant. Funding is also not a one-time task. Each time the property is bought, sold, or refinanced, the title and trust paperwork must be kept current. If no one does this, the trust may not match the actual ownership.

Mortgage, Lender, and Title Insurance Issues

A transfer to a trust can affect the loan and the title insurance, so check both before you sign. Many mortgages include a due-on-sale clause, which can let the lender call the full loan due after a transfer. Read the loan documents or ask the lender how a transfer to a trust is treated.

Title insurance needs its own question. A trustee who holds title to property received from a settlor or estate does not have to get title insurance or proof of marketable title until one is required for a sale or conveyance. Fla. Stat. § 736.08105 covers that timing. It does not answer whether an existing policy keeps its coverage after the title changes. Ask the title insurer that question directly.

Lenders and buyers may also ask for more paperwork later. Refinancing or selling land held in a trust may require the trustee’s signature and documents that show the trustee has authority to act. Gather those documents early so a deal is not delayed.

Loss of Direct Control and Reliance on the Trustee

Once land is in a trust, the trustee holds legal title, so the owner may not make every decision alone. The trustee signs leases, sales, and loans for the trust. That step can slow decisions, especially when the trustee is out of town or the family disagrees.

The trust’s terms decide who can direct the trustee and what the trustee may do. Vague instructions create gaps, and gaps create disputes. The document should answer practical questions, such as who approves a sale and who collects rent.

Florida law sets standards for trustees. A trustee must administer the trust solely in the interests of the beneficiaries. A trustee must also administer the trust as a prudent person would. That means using reasonable care, skill, and caution. A family member who serves as trustee may not know these duties, so learning them early helps.

Lawsuits, Creditors, and Trust Disputes Involving Real Estate

A trust does not remove land from every claim or every fight. Disputes can arise over who controls the land, what the trust terms mean, and whether the trustee acted properly. If a trustee breaks a duty to a beneficiary, a court can order the trustee to account, pay money or restore property, or be removed. The court can also reduce or deny the trustee’s compensation. Fla. Stat. § 736.1001 lists these remedies, along with others such as appointing a special fiduciary, suspending the trustee, and voiding a trustee’s act, and allows the court to order any other appropriate relief.

Challenges to a trust have their own timing. Under Fla. Stat. § 736.0207(2), an action to contest the validity of all or part of a revocable trust, or the revocation of part of one, may not be commenced until the trust becomes irrevocable by its terms or by the settlor’s death; the statute does not prohibit such an action by the guardian of the property of an incapacitated settlor. Fla. Stat. § 736.0207 sets out those rules.

Creditors are another issue. While the owner is alive, a revocable trust’s property is subject to the owner’s creditors to the extent it would not be exempt if the owner held it directly. So putting land in a trust may not shield it from the owner’s creditors.

Disputes often start when the trust is unclear about use, rent, or sale. Contested trust matters can take time and money, so clear drafting matters from the start.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Homestead, Property Tax, and Tax Basis Questions

Moving a Florida home into a trust can affect homestead protection, so the deed and trust terms need review. Fla. The exact rights kept matter, so the details need a close look.

Federal estate tax has its own rule. The gross estate can include property transferred to a trust if the owner kept a power to change or revoke it at death. Tax basis for property acquired from a decedent follows 26 U.S.C. § 1014.

Whether these rules change the result depends on the facts, such as the type of trust, the property’s use, and the owner’s residence.

Next Step: Talking Through a Specific Property

If you’re weighing a parent’s plan or reviewing a deed you already signed, you don’t have to sort out the deed, the loan, and the family questions on your own.
