Marenco · Published October 25, 2026

Yes, a trust distribution can be paused while a dispute is pending in Florida. It is not automatic, though. A pause usually comes from a written agreement, a trustee’s own decision to hold funds, or a court order. If you are searching for how to freeze trust distribution during a dispute Florida, this guide walks through the steps in order. It covers timing, notices, deadlines and where a case is filed.

Why a Trust Distribution Can Be Paused While a Dispute Is Pending

A pending dispute does not automatically stop the trustee from running the trust. Florida law says the trustee keeps administering the trust as if no case had been filed.

There is one limit. No action may be taken, and no distribution may be made to a beneficiary, in a way that goes against the rights of people who could be affected by the outcome. That limit is the first reason a payment can be held.

A court can also make an exception. On motion and after notice to interested persons, a court may authorize a distribution on good cause shown. The court can attach conditions, including a bond posted by the beneficiary.

“Freeze” is not one legal step. In practice it means one of three things. The trustee holds the money, the parties sign a written standstill, or a court orders the trustee to stop. A court can enjoin a trustee from committing a breach of trust.

No one can promise how a court will rule. The result depends on the trust terms, the facts and the judge. Treat this as a map of your options, not a forecast.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Confirm the Distribution Timing and What the Trustee Has Told You

Start by finding out what the trustee has told you, in writing, and when.

You can also ask. The trustee must also share relevant information about the trust’s assets, liabilities and administration. Put every request in writing so you have proof.

Gather these items before you call a lawyer:

The trust instrument and every amendment

Any distribution notice or letter about a planned payment

Every trust accounting you have received

Emails and letters exchanged with the trustee

The date on a notice or check matters. A final accounting must include a plan of distribution for any undistributed assets. Write down that date, because a trust accounting must run from the date of the last accounting or, if none, from the date on which the trustee became accountable.

Deadlines That Control How Fast You Must Act

Florida sets more than one time limit, and each one starts from a different event. The right deadline depends on the type of trust and the notices you received. Do not assume you have plenty of time.

Under Fla. Stat. § 736.1008, claims by a beneficiary against a trustee for breach of trust are barred as provided in chapter 95 as to matters adequately disclosed in a trust disclosure document, with the limitations period beginning on the date of receipt of adequate disclosure. The period depends on whether matters were adequately disclosed and on the dates of receipt of the relevant documents.

A contest of a revocable trust has its own rule.

A trustee’s written limitation notice works differently. It warns that claims based on matters in a trust accounting may be barred, and the six-month period runs from receipt of the accounting or the notice, whichever is later. Under Fla. Stat. § 736.1008, unless sooner barred by adjudication, consent, or limitations, a beneficiary is barred from bringing an action against a trustee for breach of trust with respect to a matter adequately disclosed in a trust disclosure document unless a proceeding to assert the claim is commenced within 6 months after receipt from the trustee or a trust director of the trust disclosure document or a limitation notice that applies to that disclosure document, whichever is received later.

Waiting has a cost. A missed deadline can limit your remedies, even when your concern has real merit. Build a dated timeline that starts with the day you received each notice.

Non-Court Steps: Written Demand and a Negotiated Standstill

A written demand and a signed standstill can pause a payment without an immediate lawsuit. Start with a letter, then ask the trustee to agree to the hold in writing.

Send the demand to the trustee, or to the personal representative if an estate is involved. Ask that the distribution be held while the dispute is resolved. Name the trust, the payment, the date and the reason. Keep the tone factual.

A standstill is a written agreement to hold a payment. The trustee and the interested parties sign it. Florida law also allows a nonjudicial settlement agreement among trustee and beneficiaries on certain matters.

That agreement has a limit. It is valid only to the extent a court could properly approve its terms. Any interested person may also ask a court to approve or disapprove it.

If a key person does not sign, the pause may be incomplete. Check who holds an interest before you rely on it. Keep the demand, proof of delivery and any reply. That record shows when you objected.

Emergency Injunction: What the Court Looks At

Under § 736.08165(1), while a proceeding filed to determine the validity of all or part of a trust, or who the beneficiaries of all or part of a trust are, is pending, the trustee continues administering the trust, but no action may be taken and no distribution may be made to a beneficiary in contravention of the rights of those persons who may be affected by the outcome of the proceeding. Florida’s trust statute lets a court make an exception to the hold only on good cause shown, after notice to interested persons. Fla. Stat. § 736.08165

An injunction is a court order that tells a person to stop an act.

An emergency request usually comes with a written motion, supporting facts and a proposed order. The facts must be specific. Name the asset, the payment, the date and the harm that would follow if the money leaves.

Plan for the notice step. The statute requires notice to interested persons before a court can make an exception. If a beneficiary wants a payment released, the court may require that beneficiary to post a bond.

Money already paid out is harder to recover. Acting before the payment date is usually the stronger position.

Filing the Complaint and Emergency Motion in the Right Court

A trust dispute starts with a complaint in the circuit court. Judicial proceedings about trusts begin by filing a complaint and follow the Florida Rules of Civil Procedure.

The circuit court has original jurisdiction over proceedings under the Florida Trust Code.

Venue is the county where a case is filed. A trust case may be filed in a county where venue is proper under chapter 47, where the beneficiary suing or being sued lives or has its principal place of business, or where the trust has its principal place of administration.

Check where the trustee runs the trust before you file. The county of administration can matter as much as where the parties live.

A typical filing package includes a complaint stating the claim, a motion asking the court to hold the payment, a sworn factual statement and a proposed order. A trust is not under continuing court supervision unless the court orders it, so you usually start the case yourself.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What a Beneficiary Must Prove: Elements and Contest Grounds

In a trust contest, the person challenging the trust carries the burden.
