Three questions usually decide it: did the amendment follow the trust’s own method, did the settlor have the required capacity, and was the change free of fraud or undue influence?

What a Trust Amendment Is and Why Signing Matters

A trust amendment is a written change to a revocable trust that leaves the original trust in place. A restatement replaces the whole document. A new trust replaces the old one entirely.

Signing details matter because they can change who inherits. An amendment that is missing a signature, skips a witness or notary step the trust requires, or was signed when the settlor lacked capacity can alter the plan.

This guide is for beneficiaries, heirs, successor trustees and personal representatives who have found an amendment they did not expect. If you are one of them, the change may affect your share. A challenge turns on the specific document, so no two cases look the same.

If an amendment you did not expect is now in front of you, you don't have to sort out the signing questions alone. Under Fla. Stat. § 736.0602, a settlor may amend a revocable trust by substantial compliance with a method in the trust terms. A trust that says it is irrevocable is not changed this way.

If the trust sets no method, a later will or codicil can make the change if it expressly refers to the trust or specifically leaves property that would otherwise have passed under the trust. Another method also works if it shows clear and convincing evidence of the settlor’s intent, under the same statute.

The settlor’s capacity matters too. The capacity needed to amend a revocable trust is the same as the capacity needed to make a will, under § 736.0601.

Check these points on the document:

The amendment method clause in the trust.

The date and the settlor’s signature.

Any witness or notary step the trust requires.

Whether and when the trustee received the amendment.

Grounds for Challenging an Improperly Executed Amendment

Challenges to trust and estate documents are fact-specific, and the circumstances of each situation determine which issues may be raised. Each one asks a different question.

Failed method. Did the signing substantially follow the trust’s method? A missing signature or skipped witness step raises this question.

Lack of capacity. Did the settlor have the capacity needed to make a will at the time of signing?

Undue influence, fraud, duress or mistake. If Fla. Stat. § 736.0406 applies, a trust or part of a trust procured by these means is void.

A document that is not genuine. A signature that is not the settlor’s own raises a separate question.

A hospital stay does not decide the question by itself. What matters is the evidence of the settlor’s capacity and independence at the signing.

The person challenging the amendment carries the burden. Under § 736.0207(1), the contestant must establish the grounds for invalidity.

Evidence That Usually Decides These Disputes

The evidence about the settlor’s health and the signing circumstances usually decides these disputes. Records from the days and weeks around the signing often carry the most weight.

Useful evidence includes:

Medical records from the period around the signing, such as admission and discharge notes, medication records and observations of mental state.

Who was present, who arranged the signing, who drove the settlor and who gained from the change.

Earlier trust versions and estate planning documents, showing whether the change fit long-standing intent.

Witness accounts and the drafting attorney’s file, where they exist.

Emails, texts or letters about the amendment and its timing.

Records can become harder to obtain as time passes. Early requests help preserve the evidence that matters most.

How a Challenge Proceeds, Step by Step

A challenge usually moves through five steps, from gathering documents to resolving the dispute or filing in court. The length of each stage depends on the court’s schedule and on whether the other side contests the claim.

Gather the documents. Collect the trust, each amendment, notices and account statements showing how the trust is run.

Review the amendment. Compare the signing to the trust’s method clause and Florida requirements to find any defect.

Collect evidence. Request medical, financial and witness records, and preserve documents before they are lost.

Check deadlines. Time limits are strict, so review them early.

Resolve or file. Attempt resolution where appropriate, then file in the proper Florida court if needed.

Deadlines matter most.
