The cost follows the steps the court requires, and those steps change with each dispute. If you are asking how expensive it is to contest a trust, the answer turns on the facts of your situation. This page explains the main cost drivers, how Florida law treats attorney fees and costs, and what to check before you decide.

The cost of contesting a trust follows the steps the case needs

A trust contest is a court case, so its cost follows the work the case requires. There is no flat charge that covers every dispute. Maybe you received a distribution you did not expect. Maybe a parent’s plans changed near the end of life. In each case, the trust’s terms, the paperwork, and the other side’s response shape the work.

A dispute over one clause can be short. A dispute over capacity, undue influence, and past trustee decisions can run much longer. Florida places the first burden on the person challenging the trust. Under Fla. Stat. § 736.0207, the contestant has the burden of establishing the grounds for invalidity. More proof usually means more work.

If a trust you did not expect has left you unsure what to do next, we invite you to talk with our Coral Gables attorneys about your specific trust. Attorney time comes first. Someone must read the trust, every amendment, and related estate-planning documents, then compare them to the facts.

Discovery comes next. Discovery means requests for documents, depositions, and subpoenas to banks, brokers, and prior advisors. Each request adds time for both sides.

Expert witnesses come in when the case turns on something technical. Appraisers can value property. Accountants can trace money. Handwriting or medical witnesses may address signing and capacity. Each one adds cost of its own.

Court filings and hearings come next. Every motion, every service of papers, and every hearing adds time. The more motions a case needs, the higher the total climbs.

Finally, accountings and tracing matter when the dispute covers past trustee decisions. Tracing follows money through accounts over time. That work requires careful review of records.

Florida law lets a court award attorney fees and costs in some trust cases

Florida’s Trust Code sets rules for fees and costs in trust proceedings. The rules depend on the type of case. Under Fla. Stat. § 736.1004, in all actions for breach of fiduciary duty or challenging the exercise of, or failure to exercise, a trustee’s powers, the court shall award taxable costs as in chancery actions, including attorney fees and guardian ad litem fees.

Under Fla. Stat. § 736.1006, in all trust proceedings, costs may be awarded as in chancery actions.

Florida also follows the American Rule. Under Price v. Tyler, each party generally bears its own attorneys’ fees unless a contract or statute provides otherwise. So the statutes can shift fees in trust cases, but the default is that each side pays its own. Which rule applies turns on the proceeding and the court’s findings.

Costs can be paid by the trust, by a party, or allocated by the court

Costs may come from the trust itself or from a person’s share of it. Under Fla. Stat. § 736.1005, a lawyer who served a trust may ask the court for reasonable compensation from the trust.

The court may assess fees against one or more persons’ part of the trust. In making that call, it may weigh the strength of each side’s claims and whether a person prevailed. It may also weigh whether a person unjustly increased the fees. The court does not need to find bad faith to assess a share.

Timing matters too. Early motions and broad discovery requests can raise the total. While a proceeding is pending, the trustee keeps administering the trust as if no proceeding had begun. Under Fla. Stat. § 736.08165, while a proceeding on the validity of a trust or its beneficiaries is pending, no action may be taken and no distribution may be made to a beneficiary in contravention of the rights of those who may be affected by the outcome, unless the court, upon motion of a party and after notice, on good cause shown, makes an exception.

Mediation can resolve some trust disputes, but it cannot promise a result

Mediation is a negotiation guided by a neutral helper. Under Fla. Stat. § 44.102, a court must, upon the request of one party, refer to mediation any filed civil action for monetary damages, provided the requesting party is willing and able to pay the costs of the mediation or the costs can be equitably divided between the parties, unless one of the statute’s listed exceptions applies. The statute lists exceptions, and the requesting party must be able to pay the costs or have them equitably divided. Whether that rule covers a given trust dispute turns on its claims.

When a court refers a case to mediation, the statute also pauses the time to respond to certain settlement offers. The pause lasts until the mediator declares an impasse or reports that no agreement was reached.

Mediation can resolve some issues before the most expensive phases of a case. It is a process, not a result. No settlement outcome can be promised, and a mediator cannot force one.

Before you decide, answer these questions about deadlines and documents

Start by knowing your role. A beneficiary, an heir, and a fiduciary have different standing and remedies. Deadlines matter as well. Under Fla. Stat. § 736.0207, a challenge to all or part of a revocable trust cannot start until the trust becomes irrevocable by its terms or by the settlor’s death; if all of a revocable trust has been revoked, a challenge to the revocation cannot start until after the settlor’s death. This does not prohibit such action by the guardian of the property of an incapacitated settlor.

Under Fla. Stat. § 736.0604, a challenge to a trust that was revocable at the settlor’s death is barred if not commenced within the earlier of the period provided in chapter 95 or six months after the trustee sent the person a copy of the trust instrument and a notice of the trust’s existence, the trustee’s name and address, and the time allowed for commencing a proceeding.

Document requests are a practical first step. Under Fla. Stat. § 736.0813, a trustee must give a qualified beneficiary a complete copy of the trust instrument on reasonable request. The trustee must also share relevant information about assets, liabilities, and administration.

Florida also makes a no-contest penalty unenforceable. Under Fla. Stat. § 736.1108, for trusts created on or after October 1, 1993, a trust provision that penalizes an interested person for contesting the trust instrument or instituting other proceedings relating to a trust estate or trust assets is unenforceable.

Evidence is the last question. A California Courts undue influence guide notes that undue influence can be difficult to prove.

Quick answers

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How expensive is it to contest a trust?

No single price applies.
