Marenco · Published October 18, 2026

How much does it cost to talk to a probate lawyer? The first conversation is where most people start, and it’s the right place to ask. Cost depends on the estate, the court process, and whether anyone disputes the will or the assets. This guide explains what that first talk covers and what drives probate costs in Florida. It also shows what to clarify before you agree to anything.

What a First Conversation With a Probate Lawyer Involves

A first conversation is a free talk about your situation, not a contract to hire anyone. Many people ask how much it costs to talk to a probate lawyer before they share any details.

Most people reach this step after a death in the family. They are often grieving, and the court process is new to them. A probate lawyer listens to the basic facts: who died, whether there is a will, what property and debts are known, and whether anyone disagrees about the estate. The lawyer then explains the general steps. You leave knowing which decisions may come next.

Bring any papers you already have, such as a will, a death certificate, or a letter from the court. Early facts help the conversation stay focused on your estate instead of general guesses. Write down your questions beforehand. A short list keeps the talk useful, especially when grief makes it hard to think clearly.

The first consultation is free, confidential, and carries no obligation to continue. You can take time to think before choosing a next step.

If a family member has died and costs feel unclear, you don't have to sort them out alone. Several facts shape the work:

Whether there is a will, and whether it is self-proved.

The size and types of assets, including any real property.

Whether creditors file claims or beneficiaries raise objections.

Whether the matter becomes contested in court.

A simple, uncontested administration usually involves less work than one with disputes, missing documents, or litigation. Real property often needs extra steps before it can be sold or transferred. A common mistake is assuming every estate costs about the same. A family with a clear will and no objections often moves on a different path than one where a relative challenges the will. Ask the lawyer which of these facts apply to you, and why.

How Probate Lawyer Fees Are Discussed in Florida

Florida law sets a reasonableness standard for probate attorney fees. Under Fla. Stat. § 733.106, any attorney who has rendered services to an estate may be awarded reasonable compensation from the estate.

Under Fla. Stat. § 733.6171, attorneys for personal representatives are entitled to reasonable compensation payable from estate assets without court order, subject to the statute’s exceptions. The statute also says that an attorney for a personal representative who intends to charge a fee based on the statute’s schedule must make written disclosures, and if the attorney does not, the attorney may not be paid for legal services without prior court approval of the fees or the written consent of all interested parties.

Florida’s lawyer fee rule adds a writing requirement. Under Florida Bar Rule 4-1.5, written documentation is required to avoid misunderstandings about the nature of legal fees when any aspect of the fee is nonrefundable. Ask how the fee is set, how it’s billed, and when it is due. Ask for those answers in writing before work begins.

Costs Beyond Attorney Time: What Else an Estate May Owe

Court and other costs are separate from what the lawyer charges. They depend on the estate and the court process. Common categories include court filing fees, certified copies of records, appraisals, and other expenses the process requires.

Under Fla. Stat. § 733.106, in all probate proceedings, costs may be awarded as in chancery actions. The court, in its discretion, may direct which part of the estate pays costs and attorney fees. Fla. Stat. § 733.106 reads: “If costs and attorney fees are to be paid from the estate under this section, s. 733.6171(4), s. 736.1005, or s. 736.1006.” It may also assess them against one or more persons’ parts of the estate in proportions it finds just and proper.

That matters because costs paid from the estate reduce what is left to distribute to heirs and beneficiaries. A stated fee or cost should disclose everything you may owe, including filing and other costs. Ask for the complete list at your consultation, not only the attorney’s fee. Writing these items down helps you see the full picture before you decide.

What a Personal Representative or Trustee Is Entitled to Be Paid

A personal representative (often called an executor) and a trustee are paid under their own rules, separate from the lawyer’s fee. Under Fla. Stat. § 733.617, a personal representative is entitled to a commission from estate assets without court order as compensation for ordinary services. Under Fla. Stat. § 733.617, a commission computed on the compensable value of the estate is presumed to be reasonable compensation for a personal representative in formal administration as follows: 3 percent for the first $1 million, 2.5 percent for all above $1 million and not exceeding $5 million, 2 percent for all above $5 million and not exceeding $10 million, and 1.5 percent for all above $10 million. A personal representative may also renounce all or part of that compensation.

For a trustee, Fla. Stat. § 736.0708 says that if the trust does not specify pay, the trustee is entitled to compensation that is reasonable under the circumstances. Read the trust or will to see whether it sets pay terms for the fiduciary.

Trust Counsel’s attorneys can serve individually as trustee or personal representative. The firm advises and represents trustees, personal representatives and beneficiaries, so your role decides which questions apply.

Do You Need a Lawyer for a Florida Probate?

Some estates move through the court with fewer steps, while others involve deadlines, creditor claims, or family objections where legal advice matters. A self-proved will can help.

Creditor deadlines are another point. Under Fla. Stat. § 733.702, a claim against the estate is binding only if filed in the probate proceeding by the later of 3 months after the first publication of the notice to creditors or, for a creditor required to be served, 30 days after service. A claim filed late is generally barred unless the court extends the time, and an extension may be granted only upon grounds of fraud, estoppel, or insufficient notice of the claims period.

Disputes such as a will contest are separate proceedings with their own rules, and they can add significant work. For the wider picture, see Trust Counsel’s probate litigation attorney page, which covers disputes that reach the court.

Not sure what your next step is?

Talk it through with Trust Counsel, PL — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Questions to Ask About Cost at Your Free Consultation

Ask how the fee is calculated, which costs come beyond attorney time, and how and when billing happens.
