It usually starts when the person who created the trust (the settlor) dies or becomes incapacitated. This guide explains what trust administration involves, what a successor trustee must do, and when to contact a trust administration law firm in Florida.

What Trust Administration Means Under Florida Law

Trust administration is the process of managing trust property, paying the trust’s bills and distributing what remains. The Florida Trust Code applies to express trusts, whether charitable or noncharitable (§ 736.0102). Once a trustee accepts the role, the trustee must act in good faith, follow the trust’s terms and serve the beneficiaries’ interests (§ 736.0801).

A will often leads to a court case called probate. In that case, a personal representative (often called an executor) manages the estate. Trust administration usually runs on the trust’s terms instead. Assets titled in the trust generally avoid probate. Assets left outside the trust may still need a probate case.

If a family member has died and a trust names you successor trustee, you don't have to work through the first steps alone. That includes:

Successor trustees named in the trust document who must step in.

Beneficiaries and heirs who need to know their rights to information and distributions.

Co-trustees who must divide duties among themselves.

Personal representatives whose estate and trust must be handled together.

Trust Counsel’s attorneys can serve individually as trustee or personal representative.
